Cropwise Grower Mobile Application

Welcome to the Cropwise Grower mobile application (the "App"). This App is published by or on behalf of Syngenta and its local affiliates listed below (collectively, "Syngenta," including their respective assignees, affiliates, and successors). The App serves growers in Indonesia, Malaysia, the Philippines, and Thailand and provides various services including but not limited to weather information, seed variety and crop agronomy practices information, crop protection product recommendations, loyalty programs, and related features (collectively, the "Services").

Syngenta respects data privacy rights and is committed to protecting Personal Data (defined below) collected on the App in compliance with the applicable data protection laws of each country where the App operates, including:

• Indonesia: Law No. 27 of 2022 concerning Personal Data Protection and its implementing regulations;
• Malaysia: Personal Data Protection Act 2010 and its regulations;
• Philippines: Republic Act No. 10173 (Data Privacy Act of 2012) and its regulations; and
• Thailand: Personal Data Protection Act B.E. 2562 (2019) and its regulations.

This privacy policy ("Privacy Policy") informs you of your rights with regard to your Personal Data that has been and/or will be collected and processed by Syngenta.

PLEASE READ THIS PRIVACY POLICY CAREFULLY. BY USING OR ACCESSING THE APP OR ANY OF THE SERVICES AND PROVIDING PERSONAL DATA, YOU CONSENT TO SYNGENTA'S USE, PROCESSING, DISCLOSURE, AND TRANSFER OF YOUR PERSONAL DATA IN ACCORDANCE WITH THE TERMS OF THIS PRIVACY POLICY. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, YOU MAY WITHDRAW YOUR CONSENT VIA THE APP OR BY CONTACTING THE APPLICABLE SYNGENTA ENTITY AS SET OUT IN SECTION 12 BELOW.

YOU REPRESENT AND WARRANT THAT YOU HAVE OBTAINED EXPRESS CONSENT FROM ANY INDIVIDUAL WHOSE PERSONAL DATA IS OR MAY BE SHARED BY YOUR USAGE OF THE APP OR SERVICES.

IF YOU ARE UNDER 21 YEARS OF AGE, OR UNDER LEGAL GUARDIANSHIP, PLEASE ENSURE THIS PRIVACY POLICY IS READ AND APPROVED BY YOUR PARENT OR LEGAL GUARDIAN BEFORE YOU ACCESS OR USE THE APP.

Definitions

For purposes of this Privacy Policy:

"Personal Data" means information relating directly or indirectly to a data subject who is identified or identifiable from that information, or from that and other information in the possession of a data user, including any sensitive personal data and expression of opinion about the data subject, including but not limited to name, identity card number or national identification number, date of birth, mobile number, gender, address, location data, device information, and usage data.

"User(s)" or "you" shall refer to any individual who registers and uses the App and/or Services.

"Platform" refers to the Cropwise Grower mobile application and/or the website with domain https://www.cropwise.com/, together with any derivative sites.

In the event this Privacy Policy is translated into a language other than English, the English language version of this Privacy Policy shall prevail and be binding.

1. Collection of Personal Data

1.1 Data You Provide to Us

To use the App, you are required to provide personal information such as your name, address, province or region, mobile number (for generation of a one-time password (OTP) for verification and sign-in purposes), store code (where applicable), and other personal details as required by the App during registration.

Where you participate in campaigns, loyalty programs, or reward redemptions, you may be asked to provide additional personal information as requested by Syngenta or its sponsors.

1.2 Location Data

The App may contain functions that collect information on your location, such as via Global Positioning Systems (GPS), your mobile network, Wi-Fi, or Bluetooth beacon. Syngenta may collect and use your precise (or GPS) location information collected from the App to enhance your use of the App by providing you with curated information and Services, including presenting campaigns or relevant activities.

1.3 Device Information

Syngenta may collect your mobile device IP address, hardware model, operating system and version, software, IMEI number, unique device identifiers ("Device Identifier"), advertising identifiers, serial number, device motion information, mobile network information, language preferences, and/or browser type for any mobile phone, tablet, or other device (each, a "Device") used to access the App. A Device Identifier is automatically assigned to your Device, and Syngenta's servers may identify your Device by its Device Identifier.

1.4 Camera and Image Access

The App will not access your images or camera without obtaining your prior express permission. If you give the App permission to access photos or your camera, the App will use images that you specifically choose to share via the App. You may at any time manage your image and camera preferences by turning off this feature in your Device settings.

1.5 Usage Data

When you use the App, Syngenta may automatically collect and store information about your usage, including but not limited to: search data, details of points accumulation and reward redemptions (where applicable), type of content you view or interact with, features you use, time and date of access, login times, behavioral and interaction data, browsing history, and other usage statistics.

1.6 Cookies and Similar Technologies

The App and Platform may use cookies, pixel tags, and similar technologies to measure activity and traffic patterns, improve user experience, retain user preferences, and serve relevant content or advertising. Cookies are small data files placed on your device that allow the Platform to recognize returning visitors.

You may configure your device or browser to reject cookies, although doing so may limit your ability to use certain features of the App. For more information on managing cookies, please refer to your device and/or browser settings.

1.7 Data from Third-Party Sources

Syngenta may also collect Personal Data from third-party sources, including:

• Agents, vendors, partners, and other service providers that obtain your Personal Data with your prior consent;
• Third-party platforms and social media accounts that you link or connect with your App account;
• Publicly available personal information, such as social media pages, blogs, and public records; and
• Third parties involved in user verification, know-your-customer (KYC) processes, and product or service assessments.

1.8 Third-Party Services

When you access the App, you may be directed to third-party pages to facilitate additional services. Additional information may be collected and stored by a third-party service provider. Syngenta does not have control over such third-party service providers, and you shall provide such information at your sole risk.

1.9 Optional Requests

Syngenta may from time to time include in the App optional requests for information from Users, including but not limited to user surveys for purposes of customization or delivering personalized information or Services to Users.

2. Accuracy of Personal Data

Each User shall be solely responsible for the accuracy, correctness, truthfulness, and completeness of all Personal Data (of the User or otherwise) shared with Syngenta on the App. In the event a User shares any Personal Data on behalf of a third party, such User represents and warrants that he/she has the necessary authority or has obtained written consent from the third party to share such Personal Data with Syngenta, and Syngenta shall not be responsible or liable for verifying the same.

3. Use of Personal Data

Syngenta may use your Personal Data for the following purposes:

3.1 To complete registration formalities or requirements and/or to create and manage an account for you;

3.2 To provide you with the Services and assist with any additional or technical support required;

3.3 To inform you about Syngenta's products, upcoming events, promotions, studies, surveys, news, and updates;

3.4 For the creation or development of business intelligence or data analytics (for this purpose Syngenta may share your Personal Data with certain software or tools), including analyzing user behavior, usage patterns, and general characteristics;

3.5 To provide you with a customized experience on the App, including personalized content, recommendations, and advertising based on browsing activity and interests;

3.6 To maintain and/or manage the App and/or Syngenta's relationship with you;

3.7 To contact you for the provision of any Services or respond to request(s) made by you from time to time;

3.8 For internal record-keeping or to comply with Syngenta's legal or statutory obligations, including tax and reporting obligations;

3.9 To facilitate the processing of loyalty points, campaigns, reward redemptions, and related promotional activities where applicable;

3.10 To process and use reviews, comments, or other content that you submit or post on the App, including for marketing, promotional, and publication purposes in various forms and media, both online and offline;

3.11 To conduct research, analysis, product testing, and development to improve the security and functionality of the App and develop new features and products;

3.12 To detect, prevent, and investigate prohibited, illegal, unauthorized, or fraudulent activities, including monitoring suspicious transactions;

3.13 To verify your information and Personal Data for accuracy, completeness, and compliance with applicable laws and regulations;

3.14 To facilitate mergers, asset sales, consolidation, restructuring, financing, or acquisitions involving Syngenta; and

3.15 For any other purpose not inconsistent with the above, including archiving for public interest, scientific or historical research, or statistical purposes, as permitted by applicable law.

4. Disclosure of Personal Data

Except as otherwise provided herein, Syngenta does not sell, share, distribute, or otherwise provide your Personal Data to third parties without your prior consent. Notwithstanding the foregoing, you agree that Syngenta may share your Personal Data in the following manner:

4.1 Syngenta may provide your Personal Data to its group companies, subsidiaries, and/or other affiliates for purposes of improving the App, providing feedback, responding to queries, or performing data processing on behalf of Syngenta;

4.2 Syngenta may provide your Personal Data to third-party service providers, including but not limited to third-party logistics partners, payment gateways, marketing partners, research firms, consultants, and other vendors who work with Syngenta in connection with operating the App and/or providing the Services. All such service providers are subject to stringent confidentiality restrictions consistent with this Privacy Policy;

4.3 Syngenta may transfer your Personal Data if it is acquired by another entity, or if it merges with another entity or transfers a part of its business, including the App, to a third party. Any such third party or entity that receives your Personal Data shall have the right to continue to use your Personal Data in accordance with the purposes set out herein. Syngenta may notify you in the event of such sale, merger, or transfer;

4.4 Your Personal Data may be shared with Syngenta's internal business units for purposes of improving the Services or other offerings;

4.5 Syngenta may disclose your Personal Data to government and public authorities for reasons of security, law enforcement, or other issues of public importance. Where legally permitted, Syngenta may inform you prior to any such disclosure. Syngenta may also disclose your Personal Data if it determines in good faith that such disclosure is necessary to comply with its legal obligations, enforce its agreements, protect its or other User rights, resolve legal conflict or disputes, and/or investigate fraud or other wrongdoing or non-compliance;

4.6 Syngenta may provide your Personal Data to business partners or third parties in connection with your use of integrated services, including applications or sites connected through Application Programming Interfaces (APIs), or business partners with whom Syngenta collaborates to offer promotions, events, or special services; and

4.7 Syngenta may disclose your Personal Data in connection with any legal proceedings between you and Syngenta, or between you and any third party, in relation to the Services provided on the App.

5. Cross-Border Transfer of Personal Data

Syngenta and its subsidiaries and affiliates are engaged in a global business and maintain facilities and databases in various countries. Personal Data may be stored, transferred, or processed outside the country where it was collected by parties working for Syngenta in other countries, or by third-party service providers, vendors, suppliers, partners, contractors, or affiliates of Syngenta. When Syngenta transfers Personal Data to another jurisdiction, Syngenta will take commercially reasonable precautions, in accordance with applicable law, to protect the confidentiality and security of your Personal Data and to ensure a level of protection consistent with this Privacy Policy.

6. Retention of Personal Data

Syngenta may retain your Personal Data for as long as it is required to be retained for the purposes of providing access to the App and/or the Services, or for as long as Syngenta has a legitimate business need to do so. Syngenta may also retain and use your Personal Data as necessary to comply with its legal obligations (including tax, data protection, retention, and accounting requirements), enforce its agreements, protect its or other User rights, resolve legal conflict or disputes, and/or investigate fraud or other wrongdoing or non-compliance.

Syngenta will delete and/or anonymize your Personal Data when (i) it is no longer necessary to fulfill the purpose for which it was collected, and (ii) retention is no longer required for compliance with applicable laws and regulations, unless you specifically request earlier deletion, subject to the condition that you may no longer be able to use the App or transact on the Platform.

7. Security of Personal Data

Your Personal Data is stored securely on third-party service providers' (including Amazon Web Services ("AWS") Data Centers) secure cloud infrastructure. Syngenta is committed to maintaining information security with a dedicated information security team, industry-standard security technologies (including firewalls, encryption, and password protection), and robust security practices.

While Syngenta provides App-appropriate firewalls and protection, Syngenta cannot guarantee the security of Personal Data transmitted, as these systems are not fully immune to unauthorized access. Data theft and pilferage due to unauthorized hacking, virus attacks, and technical issues may be possible, although Syngenta takes commercially reasonable measures to mitigate such events. The provision of information and data by you is at your own risk.

To protect your account, Syngenta recommends that you:

• Use a strong, unique password solely for your App account;
• Do not disclose your password to anyone;
• Limit access to your devices, including computers and browsers;
• Log out of your account after you have finished using the Services, especially on shared devices; and
• Read and understand this Privacy Policy in its entirety.

8. Your Rights

Subject to and in accordance with the applicable data protection laws in your country, you have the right to:

8.1 Request access to your Personal Data processed by Syngenta and obtain a copy thereof;

8.2 Request correction and/or updating of your Personal Data that is inaccurate, incomplete, or outdated;

8.3 Limit or restrict Syngenta's processing of your Personal Data, including by withdrawing your consent previously given;

8.4 Request deletion, cessation of processing, and destruction of your Personal Data under certain conditions;

8.5 Receive your Personal Data in a structured, commonly used, and machine-readable format, and to transmit such data to another controller (data portability);

8.6 Object to certain processing activities carried out by Syngenta, particularly those based on legitimate interests;

8.7 Request information regarding the identity, legal basis, purpose of the request and use of your Personal Data, and the accountability of the party requesting your Personal Data;

8.8 Object to automated decision-making, including profiling, that produces legal consequences or significantly affects you; and

8.9 Claim and receive compensation for breaches of personal data processing in accordance with applicable law.

Please note that you may access, review, and make changes to your Personal Data via your user account on the App, or by requesting Syngenta to do so. Depending on the nature of your request, Syngenta may require you to complete a Personal Data request form or seek certain details to verify such request. All requests for Personal Data made under this Section 8 will be handled within a reasonable period.

Syngenta reserves the right to refuse requests that are excessively repetitive, require disproportionate technical effort, jeopardize the privacy of others, or are otherwise impractical, in accordance with applicable law.

9. Links to Other Websites

The App may contain links to other third-party websites, platforms, or materials (collectively, "Third-Party Content"), that Syngenta does not have any control over and are excluded from the scope of this Privacy Policy. You shall access, use, and download all Third-Party Content at your sole risk. Syngenta shall not be responsible or liable for the protection and privacy of any information (including but not limited to any Personal Data) provided by you while accessing, using, or downloading any Third-Party Content. You should exercise caution and observe privacy policies applicable to such Third-Party Content.

10. Choice and Opt-Out

Syngenta may send you communications including but not limited to information relating to your use of the App and/or Services, updates, promotional information regarding the App and/or Services, and newsletters. You may opt out of receiving promotional calls, emails, and/or newsletters from Syngenta by following the unsubscribe instructions provided in such materials. Alternatively, you may opt out at any time by contacting the applicable Syngenta entity listed in Section 12 below.

11. Changes to This Privacy Policy

Syngenta reserves the right to amend this Privacy Policy from time to time without prior notice. Syngenta will not reduce your rights under this Privacy Policy without your explicit consent. Changes will be published within the App, and if there are significant changes, Syngenta will provide clear advance notice. You are advised to visit this page periodically to stay informed of any updates. By continuing to access or use the App after changes are posted, you signify your acceptance of the updated Privacy Policy.

12. Country-Specific Provisions

The following provisions apply specifically to Users in each respective country. In the event of any conflict between this section and the general provisions above, this section shall prevail for Users in the applicable country.

12.1 Indonesia

• Applicable Law: This Privacy Policy is governed by and construed in accordance with the laws of the Republic of Indonesia. Disputes shall be subject to the exclusive jurisdiction of the South Jakarta District Court.
• Data Protection Law: Law No. 27 of 2022 concerning Personal Data Protection and its implementing regulations.
• Minimum Age: If you are under 21 years of age or under legal guardianship, this Privacy Policy must be read and approved by your parent or legal guardian. Parents or guardians are required to read, understand, and agree to the terms of this Privacy Policy on behalf of the minor or ward and are responsible for all use of the App by such individual.
• Anonymous Data: You agree and grant Syngenta the right to create, use, license, or distribute your Personal Data from which all identifiable information has been removed and which has been aggregated with similar data, so that the original data forms only a part of a larger dataset.

• Loyalty and Rewards Programs: Where the App offers loyalty points, campaigns, or reward redemption features in Thailand, participation is governed by the specific terms and conditions of each campaign as announced within the App. Syngenta or its sponsors reserve the right to modify point accumulation rates, reward conditions, or campaign terms without prior notice.
